Welcome to iTryOn AI. These Terms of Service ("Terms") govern your access to and use of our AI-powered virtual try-on service for Shopify stores. By installing or using iTryOn AI, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using iTryOn AI ("Service"), you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, you may not use the Service.

2. Description of Service

iTryOn AI provides an AI-powered virtual try-on solution that allows Shopify store customers to visualize how clothing products look on them before purchasing. The Service includes:

• Virtual try-on widget integration on Shopify product pages
• AI-powered image generation for try-on visualization
• Analytics dashboard for tracking usage and performance
• Product filtering and customization settings
• Customer support and technical assistance

3. Eligibility

To use iTryOn AI, you must:

• Be at least 18 years old
• Have a valid Shopify store
• Have the authority to bind your business to these Terms
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

To use the Service, you must create an account by installing the iTryOn AI app from the Shopify App Store and completing the OAuth authentication process.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your Shopify account remains active and in good standing

5. Subscription Plans and Billing

5.1 Plans and Pricing

iTryOn AI offers three subscription tiers:

• Basic: $29/month (or $290/year) - 300 try-ons per month
• Advanced: $79/month (or $790/year) - 1,000 try-ons per month
• Ultimate: $199/month (or $1,990/year) - 3,000 try-ons per month

5.2 Free Trial

All plans include a 14-day free trial with full access to features. No credit card is required to start the trial. You will only be charged after the trial period ends if you choose to continue.

5.3 Overage Charges

• Each plan includes 20 free courtesy overages per month
• Additional try-ons beyond your plan limit are charged at $0.15 per try-on
• Overage charges are accumulated and billed when they reach $5.00 or more
• Overages are capped at 50% above your plan limit

5.4 Billing

• All billing is processed through Shopify's secure payment system
• Subscriptions automatically renew at the end of each billing period
• You authorize us to charge your payment method on file
• Prices are in USD unless otherwise specified
• We reserve the right to change pricing with 30 days notice

5.5 Refunds

Refunds are handled on a case-by-case basis. We do not offer refunds for:

• Partial months of service
• Unused try-ons within your plan
• Dissatisfaction with service results (please use the free trial to evaluate)

6. Acceptable Use Policy

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. Specifically, the Service is designed for:

• Displaying virtual try-on capabilities on your Shopify clothing store
• Helping customers visualize products before purchase
• Tracking analytics and performance metrics

6.2 Prohibited Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to the Service or systems
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to generate offensive, harmful, or inappropriate content
• Scrape, harvest, or collect data from the Service
• Resell or redistribute the Service without authorization
• Use the Service to infringe on intellectual property rights
• Exceed reasonable usage limits or attempt to bypass rate limiting

7. Intellectual Property Rights

7.1 Our Rights

iTryOn AI and all related technology, software, algorithms, trademarks, and content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription.

7.2 Your Content

You retain all rights to your product images, store content, and customer data. By using the Service, you grant us a limited license to:

• Access and process your product images for try-on generation
• Display your content within the Service
• Use anonymized, aggregated data for service improvement

7.3 Customer Photos

Customer photos uploaded for try-on purposes are processed temporarily and immediately deleted after generation. We claim no ownership or rights to customer photos.

8. AI-Generated Content

8.1 Nature of AI Generation

The virtual try-on images are generated using artificial intelligence and machine learning. While we strive for accuracy, the generated images:

• Are simulations and approximations, not photographs
• May not perfectly represent how products will look on every individual
• Should be used as a visualization aid, not a guarantee

8.2 Quality and Accuracy

We do not guarantee that AI-generated images will be:

• 100% photorealistic or accurate
• Suitable for all products or body types
• Free from artifacts or imperfections

8.3 Your Responsibility

You are responsible for:

• Providing clear, high-quality product images
• Setting appropriate customer expectations about the try-on feature
• Ensuring generated content complies with your brand standards
• Monitoring and removing any inappropriate generated content

9. Data and Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• Customer photos are processed securely and never stored
• Merchant data is protected with industry-standard security
• We comply with GDPR, CCPA, and other applicable privacy laws
• You remain the data controller for your customer data

10. Service Availability and Support

10.1 Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance (announced in advance)
• Emergency maintenance or repairs
• Third-party service interruptions
• Force majeure events

10.2 Support

We provide email support to all subscribers:

• Basic Plan: Standard email support (response within 48 hours)
• Advanced Plan: Priority email support (response within 24 hours)
• Ultimate Plan: Priority email support (response within 24 hours)

10.3 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice. We will not be liable for any modifications or discontinuation.

11. Termination

11.1 Termination by You

You may terminate your subscription at any time by:

• Uninstalling the iTryOn AI app from your Shopify store
• Canceling your subscription through the dashboard
• Contacting support at support@itryon.ai

11.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Exceed reasonable usage limits or abuse the Service

11.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• The try-on widget will be removed from your store
• Your data will be retained for 90 days, then permanently deleted
• Outstanding charges remain due and payable

12. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or quality of AI-generated content
• Warranties that the Service will meet your specific business needs

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits, revenue, or business opportunities
• Loss of data or goodwill
• Service interruptions or unavailability
• Customer dissatisfaction with AI-generated images
• Third-party claims related to your use of the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless iTryOn AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you provide or generate using the Service
• Claims by your customers related to AI-generated images

15. Third-Party Services

The Service integrates with Shopify and other third-party services. Your use of these services is subject to their respective terms and conditions. We are not responsible for:

• Third-party service availability or functionality
• Changes to third-party APIs or integrations
• Third-party data practices or security

16. Dispute Resolution

16.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@itryon.ai to attempt to resolve the dispute informally.

16.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

18. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Email to your registered email address
• Notice in your merchant dashboard
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iTryOn AI regarding the Service.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

19.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

19.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
